On June 27th, 2022 The European Court of Human Rights today announced (accepted for examination) another complaint – Gąciarek v. Poland. It concerns the suspension of a judge by an illegal Disciplinary Chamber. The complaint was communicated to the Government within days of its receipt by the Court.
Judge Piotr Gąciarek of the District Court in Warsaw was suspended on 24 November 2021 for refusing to rule with a neo-judge. In addition to the suspension, the illegal Disciplinary Chamber reduced his salary by 40%. The judge was not even notified of the hearing in the Chamber on his suspension.
The Government received a number of questions concerning violations of Article 6 of the Convention (right to a fair trial) Article 8 (right to respect for private and family life) Article 10 (freedom of expression) and Article 18 (limitation on use of restrictions on rights).
