Letter from the American Bar Assiociation (ABA) to the President of Poland regarding concerns over continued threats to the rule of law

The American Bar Association (ABA), the largest voluntary association of lawyers, judges, and other legal professionals in the world sent a letter addressed to the President of Poland regarding concerns over continued threats to judicial independence and the rule of law in Poland. 

The ABA expressed concern whether the legislative proposals currently under consideration sufficiently guarantee the impartiality and independence of the bodies responsible for appointing and disciplining judges, the rights of individual judges and lawyers, and ultimately the right to a fair trial for Polish citizens.

The ABA’s ongoing concerns over the current state of the rule of law and judicial independence – as mentioned in the letter – stem from analysis by the local legal community that suggests that none of the current legislative proposals for reform of Poland’s judiciary – including proposals for replacing the Disciplinary Chamber – satisfy the demands by the European Commission or the rulings by the CJEU and ECtHR.
