Judge Paweł Juszczyszyn, after 685 days of suspension, was reinstated to adjudication today. But as was to be expected the judge was again suspended by President of the court Maciej Nawacki.
The decision to reinstate the judge was made by the vice-president of the Olsztyn District Court Krzysztof Krygielski, who heads the court after the term of office of the president Maciej Nawacki expired on Friday, 17 December. He overturned Nawacki’s order of 4 February 2020 and ordered that judge Pawel Juszczyszyn be reinstated to adjudication and paid his full salary.
The situation changed quickly, because shortly after vice-president Krygielski’s decision, a fax from the ministry of justice arrived at the court informing of Nawacki’s appointment for a second term as president of the court. As reported by “Gazeta Wyborcza”, Nawacki announced that he would be in court after 1 p.m. – he would break his leave – and overrule the decision to reinstate judge Juszczyszyn and suspend him again. This is what happened. Maciej Nawacki interrupted his leave and overturned both the morning order of the court’s vice-president and the subsequent order of the chairman of the department in which Judge Juszczyszyn was to sit.
We would like to remind you that in a judgement dated 17 December 2021, the District Court in Bydgoszcz found that Judge Juszczyszyn had been unlawfully suspended by the Disciplinary Chamber and ordered his reinstatement. The Bydgoszcz court ruled that the Disciplinary Chamber was not a legal court and its decisions were not binding rulings.
Judge Paweł Juszczyszyn was originally suspended on 4 February 2020 by the illegal Disciplinary Chamber after he decided to comply with the CJEU ruling of 19 November 2019 and ask the Sejm Chancellery for letters of support to the NCJ.
