Judge Igor Tuleya reinstated and… again removed from adjudication

Igor Tuleya will not return to adjudication. Judge still suspended from work!

On August 8, 2022, Judge Igor Tuleya appeared at the Warsaw District Court at 8:45 a.m. However, he again did not return to work. Despite the fact that he was reinstated on Friday, August 5, 2022, in accordance with the decision of the new President of the District Court in Warsaw, Joanna Przanowska – Tomaszek, the President of the Court of Appeal in Warsaw today reversed the decision of the new President.

The persons who opposed the return of Judge Igor Tuleya to judicial service are the President of the Court of Appeal – Piotr Schab and his deputy Przemysław Radzik, who in the order referred to the internal supervision and considered that the decision of the President of the District Court in Warsaw was an administrative action inconsistent with the valid and enforceable resolution of the Disciplinary Chamber of November 18, 2020,. Ref. II DO 74/20, on authorizing the prosecution of SSO Igor Tuleyi and suspending him from his official duties.

It is worth noting that Presidents Schab and Radzik are Zbigniew Ziobro’s appointees, knowingly carrying out the political orders of the Minister of Justice. The ties of the presidents of the Court of Appeal to the executive branch lead to the complete subordination of the judiciary to Zbigniew Ziobro, the Minister of Justice.

Judge Tuleya continues to be suspended. It is worth recalling that on November 18, 2020, by a decision of the now-“liquidated” Disciplinary Chamber, which by virtue of the rulings of the European courts and the Supreme Court could not be considered an independent court, Judge Igor Tuleya was suspended from office.

As a result of the decision of the illegal institution (the Disciplinary Chamber), the judge was deprived of 25% of his salary. Judge Igor Tuleya has not ruled for 628 days.

Judge Igor Tuleya is one of those judges who, according to the European Commission’s guidelines, was to be reinstated as part of the implementation of one of the so-called “milestones,” i.e. the restoration of the rule of law in Poland. Among other things, the Commission makes the disbursement of funds from the EU Reconstruction Fund to Poland dependent on meeting this condition.

It seems that the situation in the ruling camp is becoming very tense. The struggle between factions of the executive branch continues and gives rise to contradictory decisions, the consequences of which in the form of repression are being carried by Judge Igor Tuleya. As he himself said today: “It looks like a game, it is not an ordinary situation (…)”.

In front of the District Court in Warsaw, as always, citizens, judges, prosecutors and lawyers of other professions showed up to support Igor Tuleya. Judge Tuleya, gave special recognition to the lawyers – “(…) It’s not about whether Tuleya returned to adjudication, it’s about the rule of law. We have to do our job. The support of lawyers is very important. Lawyers help me in the fight for the rule of law, in various proceedings – there are 20 of them (…).”

A judge of the Court of Appeal, also subjected to repression by Zbigniew Ziobra’s disciplinary ombudsmen, Marzanna Piekarska – Drążek, also talked about the lonely struggle of Judge Tuleya, who has to face repression every day – “(…) it is very difficult, to experience it personally, in solitude, such a severe injustice (…).”

Despite the harassment and the attempt to humiliate the judge, Igor Tuleya continues to fight for his rights and the rule of law in our country. As always, it is worth being decent, because decency in the end, always wins. “(…) It’s not that evil triumphs over good, I’m convinced that this victory will come, I’m sure it will come sooner than we expect (…)” – Judge Tuleya said.
