Have 30 Supreme Court judges resigned?

This is the question posed by the neo-judge of the Supreme Court, Paweł Czubik, in the application presented to Małgorzata Manowska. Finally, the application will be sent to the President of the Republic of Poland, who will be able to state that the service relationship of legally appointed Supreme Court judges has expired.

The case concerns 30 judges of the Supreme Court, who filed on 17 October this year. a statement that “they do not see the possibility of joint adjudication with persons appointed in the defective procedure”.
According to neo-judge of the Supreme Court Paweł Czubik, “people – allowing themselves to choose the extent to which they want to adjudicate, fussing – have in fact resigned their office”.

On the TV Republika, Paweł Czubik also added that: “I represented a larger group of judges, because I am convinced that this is the opinion of the majority of judges elected after 2018.”

The President of the Criminal Chamber, Judge Michał Laskowski stated that: “Of course it may be that now there will be an interpretation: it was a waiver. And they will cancel us. But that’s probably not going to happen. 30 judges – issuing a statement – expected a reaction, e.g. threatening them with disciplinary consequences.”
