European Court of Human Rights will examine the use of Pegasus in Poland!
The ECtHR will examine the case from the complaints of Jacek Karnowski, Dorota Brejza, Krzysztof Brejza, Ryszard Brejza, Hanna Zdanowska, Zygmunt Frankiewicz, Małgorzata Kidawa-Błońska, Barbara Nowacka and Rafał Trzaskowski.
The applicants allege, inter alia, a violation of Articles 8 and 13 of the Convention, pointing out that they had been or were highly likely to have been subjected to unauthorised and unlawful surveillance through the Pegasus software and had no means at their disposal with which to complain about the surveillance in question.
They also allege that, due to the use of Pegasus software against political opponents during the election campaign, the 2019 parliamentary elections were held in conditions contrary to the right to free elections expressed in Article 3 of Protocol No. 1 to the Convention.
