The European Court of Human Rights in Strasbourg ruled that Mariusz Muszyński is a double and not a judge of the Constitutional Tribunal. The “judgments” of the Constitutional Tribunal by Julia Przyłębska issued with the participation of doubles violate the European Convention on Human Rights!
This very important for Polish citizens judgment was issued in connection with a complaint by a Polish company (Xero Flor v. Poland) regarding a violation of the right to a fair and public hearing of a case within a reasonable time by an independent and impartial court established by law due to irregularities in the composition of the Constitutional Tribunal, which ruled in a panel with of a judge elected to the post already filled.
The European Court of Human Rights in Strasbourg stated that in this case there was a violation of Art. 6 § 1 of the European Convention on Human Rights regarding the right to a fair hearing by a tribunal established by law!
This is a very important ruling, the first one issued by an international body in the case of the Polish Constitutional Tribunal, which confirmed that the selection of 3 persons for judicial posts in 2015 was flawed, and the compositions of the Constitutional Tribunal with their participation violate the right to a court / tribunal established by law.
